- A license to carry a concealed weapon (CCW License) may never be issued to any person who violates the following criteria:
- Persons convicted of a misdemeanor offence.
- Persons convicted of a felony offence.
- Persons on parole or probation.
- Persons who are currently wanted by law enforcement.
- Persons who are illegal residents of the United States of America.
- Persons who are subject to a protective order or a temporary restraining order.
- Persons who communicate a threat to a licensed psychotherapist.
- Persons addicted to the use of narcotics.
- Persons adjudicated to be a mentally disordered sex offender.
- Persons in a mental health facility.
- Persons who have committed a crime punishable by imprisonment.
- Persons concluded to be a danger to others due to mental illness.
- Persons concluded to be not guilty by reason of insanity.
2.2. CCW License Revocation Criteria
- A CCW License may be revoked if the license holder:
- Brandishes or discharges a firearm without proper cause.
- Carries an unconcealed or unconcealable weapon on their person.
- Fails to identify to a peace officer as a license holder.
- Fails to follow Section 2.3.
- Violates any part of Section 2.1 after being issued the license.
2.3. CCW License Usage Regulations
- A CCW License holder:
- May not chamber (have an active round in the chamber) their concealed carry firearm unless there is an active threat to life or such a threat is clearly imminent. The firearm may be loaded however when concealed.
- Must not reveal their firearm unless an active threat to life is occurring or there is a clear and potential imminent threat to life which could be averted by revealing the CCW firearm. In the case of law enforcement arriving on scene or being on scene, the CCW holder must take care to comply with law enforcement orders.
- Must not consume any alcoholic beverage whilst carrying a concealed weapon.
- Must not carry the firearm on their person in government premises, with the exception of law enforcement officers or government employees at their place of work.
- Must not allow others to use their firearm under any circumstances.
- Must not assist peace officers with their duties using a firearm.
- Must immediately identify themselves as a license holder if they are detained by a peace officer and if they are at the time of detainment in possession of a firearm.
- When detained by a law enforcement officer, must surrender their firearm for the duration of the detainment if asked to do so, and shall have it returned when released from custody unless found guilty.
